Pre and Post-Nuptial Agreements
If you are planning to get married, you may want to consider a Premarital Agreement, often called a “prenuptial” or a “prenup”. This agreement will outline each prospective spouse’s separate property owned before marriage, and the property rights available for each during marriage and in the unfortunate event of a separation. Making decisions about each of your property rights ahead of time allows you to avoid uncertainties.
Divorce, Legal Separation, and Nullity
“Divorced” means you were married, but you terminated your marital status and you are now single. “Legal Separation” means you were married, you did not get divorced, but you live separate and apart from your spouse and you have divided your assets and debts, etc. A “Nullity” means your marriage was void, so it’s as though you were never married.
Collaborative Divorce
Collaborative law, also known as the collaborative practice enables you and your spouse to make a commitment to resolve any disputes without litigation and without going to court. It is an Alternative Dispute Resolution (“ADR”), which is a term used for a way to resolve issues without going through a formal Court hearing.
Mediation
A dispute often can be settled or decided much sooner with Mediation – often in a matter of months, even weeks. While the traditional litigation and trial can take over a year. Mediation saves time and reduces attorney fees, court costs, experts’ fees, and other litigation expenses.
